1. 我去年12月因domestic disturbance有arrest record, 当时并未伤人, 但惊吓到小孩. Sheriff's Office的initial charge是disorderly conduct (Class B misdemeanor. penalties: a fine not to exceed $1000 or imprisonment not to exceed 90 days, or both), Human Services听取警方汇报后决定不需介入.
我雇了criminal defense attorney, 从DA Office在arraignment之前得到pre-charging Deferred Prosecution Program(DPP)的offer letter, 于是同意并和Deferred Prosecution Unit(DPU)正式签订一个为期一年的contract(到今年年底结束), 其中规定我必须参加parenting class和定期向DPU officer交essay assignments(相当于思想汇报)再加上不能再犯同样愚蠢的错误. 所以我从未出庭见过judge, DA Office也至今没正式charge我.
如果我能顺利完成, 则my case will be dismissed without any charge. 否则, DA Office will charge me with disorderly conduct (same as initial). 故目前我的现状是有arrested without charge and conviction but with a pre-charging DPP. 我的parenting class已正式顺利完成, 已从therapist手中拿到一个正式结束证明. Essay assignment也定期准时呈交到DPU. 如不出意外, DPP应该可于年底顺利完成.
2. 现在因老婆EB2 PERM排期排到, 打算下月递交I485. 也咨询过众多移民律师, 大部分律师都说我可以DIY, 而且他们也没兴趣接我的案子帮我申请I485(可能觉得case太小). 8老师也建议过我先自己递交, 如实汇报arrest事实并收集文件来解释这次 arrest, 如移民官一定纠缠不放再找个律师求助也不迟.
我基本上决定这样做, 但现有如下问题:
我现在收集到有关我case的材料有以下:
Sheriff's Office: Police Report and Sheriff's Office Receipt for Bond/Bail/Fine with initial charge
DA Office: DPP Offer Letter and Contract, (还打算再和我的DPU officer联系一下让她再给我出一个official letter说明一下我的DPP和我的进展现状)
Court: None (因为我拿得是一个PRE-CHARGING的DPP, 从未出庭, 我律师说我的案宗还在DA Office, 根本没递交到Court)
Therapist: Official Letter to prove I have finished counselling.
这些文件是否足够说明I485中的Initial Evidence的1. Criminal history的情况(instruction那里的ABCD好像都是递交到Court过并已经定案的情况, 我这种DPP的情况并无具体说明). 非常感谢!
