请问8老师，等待485的过程中，准备用回美证回国，当时没有申请EAD，目前还是在用R1工作。当时觉得没有必要申请EAD，所以没有申请。现在想申请有个问题。过几天就要回国了，回国回来身份就会变成Parole，回来以后再申请是不是好一些。看了一下765的申请，有一些可以加快，有一些不可以加快。如果现在申请，应该不能加快；如果回来再申请是可以加快的，因为那时候是Parole，对不对？

-Not really. You had better file I-765 as soon as possible. It takes a long time for EAD to be approved. Even if you request expedite processing for the EAD, USCIS may not approve your request for expedite processing.

By the way, your EAD application is based on your pending I-485, so the EAD category should be "(c) (9)", not "(c) (11)".

"(c) (11)" is for an alien paroled into the United States in the public interest or temporarily for emergency reasons, so it is not your case (i.e., you are in a different type of parolee status after you enter US using advance parole)..

So, you must fill "(c) (9)" as the category in I-765 and provide the copy of your I-485 Receipt Notice.
