USCIS defines employment as employer/employee relationship, in other words, if you’re with the company, you’re employed even if you work part-time, on vacation, or on sick leave. But 245(k) provides protection for those who are out of status or work without authorization for not more than 180 days, since they entered US with a visa stamp(not AP) on their passports. A couple of weeks’ gap between your expired and renewed cards may not cause any troubles.

There are certain criteria (severe financial loss, etc) have to be met before the expedite service can be granted. If your company letter or phone call convinces USCIS officers, it will certainly speed up the process.
