我的情况：, 现F-1 毕业(grace period will expire 10/30/09), 已有两个口头offer。４８５ EAD (expires 3/2011) 未用过，用过公司H-1B两年，但从开始用到现在已超过６年。

问题：
１. 若申请公司H-1B是否不用等到批准就可开始工作（假设USCIS receipt available before 10/30/09）？

10/30/09之后需处境激活？
-No, if you file H1 application before your F1 expires.
若申请学校的H-1B呢？
-No difference.
或者因J-1 issue resurface 根本不会批准？
-Technically, you are not qualified for H1 before J1 waiver, but it is possible USCIS still approve your H1 application just like they did it for you before.

若我用485EAD开始工作（too risky？！）

-You still can work until your EAD expires even if your I-485 is denied unless USCIS cancel your EAD at the time your I-485 denial.
可否不离境境求助245（k）等到J-1 waiver完成在重新开始工作？
-You may need to go out of US to get an H1 visa to activate your h1, so your unlawful presence can not be > 180 days if your I-485 is denied.
这种设想有无可操作性？
３. 像我这样的485被拒，是否可file MTR？
-Yes,but you can not win unless you get J1 waiver, but you can get some more time to extend your lawful presence to get the j1 waiver. If your MTR is denied due to lack of J1 waiver, you still can file a new I-485 after you get the J1 waiver as long as your unlawful presence is < 180 days.
4. 关于J-1 waiver， 有没有人境内申请，境外完成的？一旦不成功，是否可以有途径返回？毕竟全家都在这里。
寝食不安，感谢任何建议。
