EAD use after H1B expired

I have some questions here and hope somebody can help me –

I am a dependent applicant for GC (EB1A) and H1B will be expired next February 09 (140 Pending). I plan to apply EAD card and H4 before H1B expired.

1) Am I legal after I submit H4 application before H1B expired?
2) After H1B expired and before I get my EAD card, to keep my job, can I take unpaid leave or work as volunteer, is legal?
3) After H1B expired, if I have used EAD and our 140 gets denied, what are the options to maintain my legal status?
