AOS(485 pending, no EAD)期间申请的H1b要出境激活？

H1b 被前雇主撤销，不能 tansfer, 现在处于AOS(485 pending, no EAD)状态，新申请的 H1b 用不用出境激活？ 问了三个律师，两个说要，一个说不要。 该信谁呢？
