请教皮老师有关EAD和EB1A被拒

eb1a和eb2-niw 主申请人各递了140/485。副申请人也各递了一份485，并以EB1A/485-base申请了 EAD，现在是第二年延期中（自9/1/2008）。9/12 /2008 eb2-niw-140批了，但是今天online说 eb1a 140被DENIED了。主（H1)/副申请人两个485是同一个A#。四个485都没有动静。


有两个问题：

1. 副申请人EB1A/485-based EAD还有效吗? 需要重新申请吗？

2. 如果需要，估计没有3个月下不来。副申请人正好回国2周，是不是应该在国内申请H4? （副申请人的H4)自5/2008就没有了。

3. 有关eb1a 140被DENIED：PD 5/2007-TSC(e-file), 10/2007 RFE 要求提供extraordinary的证据（十条里的三条））。就像我没有交任何supporting documents一样。印度坛子说应该是丢了，我就11月写信请他们在485的package里找找，12月为了保险重寄了一份。同时由于485转去了NSC，eb1a 140 1/2008随之转去了NSC("now NSC has the jurisdiction to this application")，之后杳无音信，中间催了两次，结果今天就被拒了。问题是：

尽管我的背景并不超强，总得没有收到一个真正的RFE就被拒而心有不甘。我应该申请re-open吗？有意义吗？

主题：EB1A/I140 RFE紧急求助!!!SRC会不会没有收到supporting documents?

EB1A/I140 E-FILE （5/2007, SRC），一周内mail (SRC) I140 supporting documents (包括petition letter) + I-485 (5/2007), 两周内分别收到receipt。

今天收到I140 RFE，要求12weeks内回复。RFE的内容是最糟糕的一种（1.证明应该递eb1a; 2.提供extraordinary的证据（十条里的三条））。总而言之，就像我没有交任何supporting documents一样。

我的问题是：

1．SRC可不可能糊涂到不知道把我的I140 supporting documents弄哪里去了。如果可能，又没有办法联系上officer问一下。（RFE署名为David Roarl, Director, officer #397）

2.我应该怎么回这个RFE？在我过去递交的petition letter中，我已经详细阐述了十个条件中的六条并附有supporting documents包括9封推荐信（欧美日biomed领域系主任一类的）共有两三inch厚。

3．是不是因为我的条件并不算特别强， officer觉得我每条的证据都不够，所以意思是让我重新递证据？

“This office is unable to complete the processing of your petition without further information..."

1. Please the persuasive documentary evidence to qualify beneficiary as an alien of extraordinary ability as required in 8 CFR sec 204.5(b)
(A) sec 203(b)1 of the Act provides for preference classification to:
(I) the alien has extraordinary ability in …(field) which has demonstrated by ….through extensive documentation.
(II) The alien seek to enter US to continue work in the area, and
(III) The alien’s entry into US will benefit prospectively the US.

7. Recommendation letters (9), from 7 universities (Eur.US.JP)
8. a reviewer for one professional journal (twice)
9. Photocopy of requested for scientific support by academic and industry colleagues.
10. scientific papers (9), paper citation and reprint requests
11. World-wide citations (30~)
12. Display of work in scientific meeting

上次已经绞尽脑汁，真想不出还可以凑点什么。请出主意。
