回复：请教8老师和其他高人，H1-B延期批复, EAD及相关问题

本人情况： H1-B 8月10号到期，我7月底向公司及律师递交了延期申请材料，USCIS Receipt Date 8月25号.

EAD 和 AP 2013 年2月1号到期。EAD Renewal 申请Receipt Date 11月5号，AP Renewal 申请 Receipt Date 11 月25号。

10月份回国一次，用AP回美国。之前专门咨询了律师是否需要撤销H1-B 延期申请，答复是不会有影响。

昨天收到H1-B Approval Letter. Notice Type: Approval Notice. Consulate: Shanghai

但是在下面一段写明： The above petition has been approved for the classification requested. It has been determined that the named worker is not eligible for the requested extension of status.

Since the worker has been found ineligible for the extension of stay, we have sent notification to the consulate shown above. If you have any questions about visa issuance, please contact the consulate directly.

If a visa is issued, upon admission in this classification the worker will be authorized to be employed by the petition for the authorized period pursuant to the terms and conditions of the petition.

律师的解释是：

As you can see from the attached Approval Notice, your H-1B Petition was approved.

However: as stated in the 1st paragraph of the notice, the extension of stay, unfortunately, was not granted, due to your re-entry into the United States (October 2012) pursuant to your Advance Parole.

想问的问题：

1. 我现在还能合法在美国工作吗？

-Yes, you can use theh EAD to work.

 

2. 这个H1-B 批复是什么意思？ 我现在要到上海去申请签证吗？

 

-The H-1 approval has no I-94,, thus you can not work using H-1B status. If you want to be H-1 holder, you need to go to Shanghai to get the H-1 visa to enter US some time later. If you do not want to be H1 holder currently, just use EAD to work.

3. 担心2月1号前，EAD申请是否能批下来。 如果到2月1号，EAD Renewal 还没批下来， 我还能合法在美国工作吗？

-No. You need to have the new EAD approval to work after the old EAD expires, or go to Shanghai to get the H-1 visa to come back to work after the current EAD expires.

4. 律师的解释是因为我10月份用了 AP, 所以 “ the extension of stay was not granted”。 我翻了坛子上之前的帖子，觉得是因为H1-B 延期申请日期 （8月25号）超过了之前的有效期（8月10号），不知理解是否正确？

 

-The lawyer explanation was wrong and your undersatnding is right. I think the lawyer mailed the H1 petition was not in the end of July, but after 10 August. So, it is the lawyer's fault in delay of the H-1 extension filing. 

5. 我现在应该怎么办？
