我的现状是EB2 485 pending about 10 - 11 month, have EAD card(never used before), worked under H1-B. I was laid off, but I will be on payroll with pay till Dec31,2012. I requested for Personal leave, so I can have more time to find next job. Company grander my request, so, beginning on Jan. 1 to Mar 31, I still will be with company, so my H1-B still valid (just no pay). I am Canadian(born in China)
My question is, if I found job between Jan and March time frame, do the H1-B transfer, is there any problem at my situation? My last pay check will be at end of Dec?
-It is possible your H1 transfer may have no I-94 and thus, you need to go to US-Canada border to get the H-1 I-94 to come back to get the H-1 status. You also can use EAD to work.
About to find similar job to sustaining my Green Card, do I need to find full timed job for it? Or contractor job will also be fine.
-It should be full-time and permanent job, but if it is contract job, your employer should indicate this job can be renewable in the letter if you receive RFE from USCIS.
the similar job means that as long as I am doing software development as before.
-As long as it is in the IT area, it will be OK.
If I find new job in a new state other than the state I filed for my 485, do I need to make address change? I am afraid of address change will mess up on final card delivery.
-If you change your address, you need to inform USCIS to update your address. This is common sense.
