回复：请教：持绿卡，离境一年之内没有返回，怎么办？

我先生去年12月份第一次拿到绿卡离开美国，原打算今年12月份返回，但天不遂人愿，暂时不可能回来了；可能明年二三月份才能回来。并且他以后也不会每年长期在美国呆。该怎么办？

1。有人说拿着绿卡试试，看能不能近来？可行吗？因为他来了一个月以后还要返回国内，我们不想进入繁琐的移民法庭程序（I suppose it will be a long time procedure)。

-He may not be allowed to enter US by using the green card if he enters US after staying in China for > one year without any reason to justify this delay return.

2。直接放弃绿卡，申请旅游签证？

-This may be the better choice if he does not plan to stay in US permanently. Of course, he can apply for the green card again if he wants to live in US in the furtue.

这种情况是在北京大使馆办就可以呢？

-Yes.

还是必须到广州大使馆办理？-Not necessary.

 

这两个程序是同时进行，可能会在同一天办理吗？

-Yes.

据说可以换成一种B2签证，十年可以免签？

-I don't know how many years the B2 visa will be valid, case by case basis.

放弃绿卡的程序会很复杂吗？-Simple. Just provide the completed I-407 and the green card to the US Consulate and at the same time apply for the B2 visa.
