我是H1B,我的EAD(出生日期有错误,USCIS说可以寄回更换,帮忙申请EAD的律师说不影响使用---只要雇主接受)在手上,

我想知道的是:
1. 假如我从这个月用或下个月用EAD,我的明年缴税将受何种影响? 比如今年前十个月的税一定要按H1B的收入要求标准工资来缴税吗? 还是可以用今年的实际收入(少于H1B要求)来缴税?

-Haven't you file tax return before? Tax return always use your actual income, not H1B income.

2. 或者我继续用H1B不用EAD,而明年缴税用今年的实际收入(少于H1B要求),那么我的GC( I-485pending )会受影响吗?

-No. As long as your I-140 sponsor show to USCIS that the employer has the ability to pay at the prevail wage for PERM (not H1), your I-485 will be fine (not need to pay you at that level before you get the green card).

有多大的可能性被审计?

 

3. 我老婆(I-485 pending)在中国,假如我用了EAD,她可以从中国申请AP吗?

-No.

-- 其实她的AP已经批准,但是寄丢了,回中国之前没有收到.

-She has to find it and use it to return to US. Otherwise, she needs to apply for the H4 visa. Therefore, you can not use EAD, otherwise she can not get the H4 visa.
