What is your current status? If you have nonimmigrant status - H1, L1, you can stay and extend your status safely. If you have lost your nonimmigrant status, you can leave US and re-enter with a new H1 status.
TN visa is not allowed to have immigration intent. You may not get TN at the POE. Good luck!
