今天close seller昨天说没有tenant deposit, contract和lease上都写明了有的

对方律师给发了那个么个邮件 那个叫强词夺理啊。。。

The seller is prepared to perform.  I spoke to him a few minutes ago and his
secretary was on her way over to the house to get the tenants to sign a
letter to the buyers that there is no security deposit.  The seller's
documents have already been fed-exed to the title company.  

The buyers' position seems to be that they won't close based on an
adjustment of money that they aren't entitled to - if the tenants sign off
that there is no security deposit, and the tenants leave the property in
good shape, the buyers are not on the hook for anything so the buyer's
aren't out any money.  On the other hand, if they insist on a credit from
Chris for the security who gets that money when the tenants leave?  The
tenant's have foregone the money, and the buyers aren't entitled to it; if
the tenants damage the property then you are asking Chris to pay for the
damages of that the tenants do.  

To put this another way, let's say for argument's sake that Chris did give
them a credit for the security; they will have to take the value of that
credit and open a bank account with the buyer's own money in the amount of
that credit for the security deposit; once the tenant leaves the property in
good shape, Chris would be the one entitled to that money because he would
have been the one that gave them the credit in the first place (remember
that the tenant has forgone the security, and the security doesn't belong to
the buyer).  And if the tenants leave the place damaged, Chris is the one
that ends up paying for the tenant's damage.  

In any event, this is where we stand.  Chris is ready, able and willing to
close today; we both want the property to close today (neither of us get
paid until it closes); and the buyer isn't being asked to pay a greater
amount either way (the credit at closing would mean that they have to take
the money and put it in an account anyway).
